Nursing Home Neglect and Abuse Liability

Do you know your rights?  Are you familiar with Public Health Law § 2801 d?  Do you really  know how to tell if a pressure-ulcer case or a case involving injuries from falls, especially in the nursing home setting is a viable claim?  Has the patient suffered from dehydration or malnutrition or medication errors or unsanitary or unhygienic conditions, or an elopement?  The above areas of inquiry, as well as others, are common complaints and issues from long-term care settings.  New York State is unlike many areas of the country in that in New York, many of these cases have not been litigated.  This is the work that we have committed ourselves to do.  Class actions in appropriate case are also a viable remedy.

These preventable indignities and injuries are not the “normal consequences” of someone moving on in years.  Your client or friend has the right to live without neglect and abuse.  The nursing homes are obligated to provide the care adequate to maintain and attain the highest practicable level for their residents. Anything less is a violation of New York State and Federal regulations and statutes.  The nursing home regulations set the standards of care related to all the types of cases I have mentioned above, such as pressure ulcer cases and cases involving falls.
